The Court in Suit No. FHC/KN/CS/107/2023, filed by Mr. Ibrahim Haruna Ibrahim against the Labour Party and the Independent National Electoral Commission, ruled that the process is invalid due to the Labour Party's failure to submit its membership register to the Independent National Electoral Commission within thirty days prior to their primaries.

He added that Akingbade, who presented himself as a Labour Party representative, did not oppose the motion, compelling the judge to postpone his decision until Thursday (yesterday).

Ifoh subsequently requested that the judiciary and all law enforcement agencies, including the police and the Department of State Services, DSS, note that Akingbade and Apapa's supporters no longer represented the party.
