The court has adjourned APM's petition until Friday to remove Tinubu as president.

The Presidential Election Petition Court (PEPC) in Abuja has postponed until Friday further proceedings regarding the Allied Peoples Movement's (APM) challenge to the results of the 2023 presidential election.

Despite the fact that the APM's petition was previously consolidated with those of Peoples Democratic Party (PDP) candidate Alhaji Atiku Abubakar and Labour Party (LP) candidate Mr. Peter Obi, the APM's case was put on hold during Tuesday's hearing.

This was prompted by a recent Supreme Court ruling, which was brought to the court's attention by President Asiwaju Bola Tinubu's legal counsel. The APM is contesting Tinubu's victory in the presidential election.

Chief Wole Olanipekun, Tinubu's attorney, argued that the Supreme Court had already addressed the APM's solitary claim that Vice President Kashim Shettima had been nominated twice prior to the presidential election.

“In this wise my lords, this particular petition which has just been called in respect of which the sole issue that is being ventilated is the nomination of the 1st Respondent who we represent,”Olanipekun explained.

“We promise that within the next two days, certified true copies of the judgement will be made available.”

Mr. S.A.T. Abubakar, the attorney for the APM, requested a postponement in order to review the Supreme Court's decision.

Mr. Abubakar Mahmood, counsel for the Independent National Electoral Commission (INEC), and Prince Lateef Fagbemi, counsel for the All Progressives Congress (APC), did not oppose the postponement request.

Therefore, the panel headed by Justice Haruna Tsammani agreed to postpone proceedings until Friday.

The petition of the APM asserts that the withdrawal of Mr Ibrahim Masari, the original Vice-Presidential candidate for the All Progressives Congress (APC), rendered Tinubu's candidacy invalid under Sections 131(c) and 142 of the 1999 Nigerian Constitution.

President Tinubu and the APC have filed motions to challenge the petition's validity, arguing that it lacks merit.

In the interim, the court has permitted APM to present its proposed witness.
