The APM had sued the Independent National Electoral Commission (INEC), the All Progressives Congress (APC), Tinubu, Shettima, and Kabiru Masari, the APC's initial Vice-Presidential candidate, on the grounds that Shettima had been illegally nominated.

During Tuesday's hearing, Tinubu's attorney, Wole Olanipekun SAN, informed the justices that a recent Supreme Court ruling addressed similar issues raised by the APM.
