Wednesday, the Presidential Election Petition Tribunal (PEPT) cautioned attorneys representing the Labour Party (LP) presidential candidate, Peter Obi, and those of the Independent National Electoral Commission (INEC) against making disparaging remarks against one another.

During Wednesday's proceedings, the main attorney for Peter Obi, Livy Uzoukwu (SAN), accused Professor Mahmood Yakubu, chairman of the Independent National Electoral Commission (INEC), of evading court summons.

Uzoukwu stated, during the resumed hearing of the Presidential Election Petition Tribunal (PEPT) in Abuja, that the INEC Chairman has refused to receive a subpoena from the court's bailiff.

After making his argument, he requested a postponement of the proceeding.

Oluwakemi Pinheiro (SAN), one of the counsels representing INEC, countered Uzoukwu by stating that the petitioners are attempting to scapegoat his client for their own failures.

According to Pinheiro, Obi's legal team has developed the tendency of always seeking an excuse whenever they wish to request a postponement.

“Don’t use INEC as a whipping boy. If they have nothing else to do today, they should just stay so. It is their day. It is not correct that the office of INEC Chairman refused to accept a subpoena.

“This habit is showing that you’re only stalling the case. You’ve only called two witnesses out of the 50 witnesses you said you would call and it has been two weeks since tribunal started,” the counsel added.

In response to the outburst, the five-member panel commanded by Justice Haruna Tsammani instructed the attorneys to refrain from disparaging one another.

“If there is anything that INEC is doing, you know what to do,” Justice Tsammani told Uzoukwu. The panel also instructed the attorneys to "calm your tempers" and stated that regardless of the outcome of the case, "we are still friends."  Consequently, the court adjourned until Thursday to continue hearings.
